In light of the recent events related to the “Generation Z 212” gatherings, legal experts explained that participants in such unauthorized gatherings not only face the penalty of violating the Public Gatherings Law, but also expose themselves to serious criminal prosecution in the event of non-compliance with security orders or resistance to its members, which are crimes whose punishments reach imprisonment.
“Failure to comply”… the crime of insult
Experts confirmed that a person’s refusal to comply with an order issued by a security officer, such as stopping to verify identity or leaving a gathering place, is not considered a minor violation. This act is often legally adapted as the crime of “insulting a public official in the performance of his duties.” Under Moroccan criminal law, this crime, which may be committed through words, gestures or threats, is punishable by imprisonment from one month to one year and a fine, meaning that mere stubborn refusal could result in a sentence of deprivation of liberty.
“Resistance”… severe penalties
The issue takes on a more serious dimension if “non-compliance” develops into “resistance,” a crime defined as the use of violence or assault to prevent members of the public force from performing their duty. The law clarifies that simple resistance (such as pushing a security officer or preventing him by force) exposes the person to imprisonment for a period of three months to a year.
The punishment is greatly aggravated if the resistance is from several people, or if it results in injury. If a weapon is used to resist security personnel, the act turns into a felony, punishable by up to many years of imprisonment.
Experts conclude that a participant in an unauthorized gathering may find himself facing a series of legal prosecutions. It begins with violating the law on gatherings, followed by the misdemeanor of insulting a public employee if he refuses to comply, and then reaches the misdemeanor or felony of resisting in the event of using force, which many people who underestimate the seriousness of defying the orders of the public force are unaware of.
