Madrid –The Public Prosecution at the Spanish National Court opposed the extradition of the Algerian businessman and oppositionist Ayoub Issio to the Algerian authorities, considering that the data provided does not provide sufficient evidence to support money laundering charges, and that a number of the crimes subject of the request have expired, according to what was reported by the Spanish website “The Objective” on October 10, 2026.
This position comes within the framework of the extradition procedure initiated by the Algerian authorities, after the Spanish police arrested Issio at Barcelona airport last July, at the request of an Algerian, before placing him in temporary detention pending a decision on the case.
The Spanish National Court decided to release him temporarily last September, at the request of the Public Prosecution, while continuing to consider the extradition request submitted by Algeria.
According to data published by the Spanish media, the Public Prosecution based its position on insufficient indicators related to money laundering charges, in addition to considering other crimes included in the request to be legally statute-barred. This means that the prosecution does not see a sufficient basis to respond to the extradition request according to the elements available in the file, without its position alone forming a final ruling in the case.
It is expected that the Spanish National Court will decide on the extradition request in accordance with the applicable legal procedure, as the Public Prosecution’s position remains separate from the final judicial decision regarding the extradition of the person concerned to Algeria.
The case is important given the nature of the financial accusations against Issio in Algeria, and the legal conditions to which extradition requests between countries are subject, which include examining the evidence provided and the extent to which the conditions related to the statute of limitations are met and the legal conditionality of the acts subject to prosecution.
The file also comes in the context of Algerian-Spanish relations that have witnessed political and diplomatic disputes in recent years. However, determining the impact of this case on judicial cooperation between the two countries remains dependent on official developments and the decisions that will be issued by the competent authorities.
The case, pending a final judicial resolution, highlights the importance of independent scrutiny of international extradition requests, as a legal procedure aimed at ensuring that the necessary conditions are met before a decision is made regarding the transfer of a wanted person to the country requesting him.
