Algeria –The decision to place an Algerian content creator in temporary detention, after he published a video clip in which he commented on a girl’s dress, sparked a wide debate about the limits of freedom of expression and the protection of children, after opinions were divided between supporters of the judicial procedure and those who rejected considering it proportional to the nature of the incident.
The Republic Prosecutor’s Office announced at the Boufarik Court that the accused would be pursued on charges related to discrimination and violating the private life of a child, before the investigating judge ordered that he be placed in temporary detention pending his trial scheduled for August 5 of this month.
On the other hand, a number of observers believe that resorting to temporary imprisonment in cases related to expression on social media raises questions about the proportionality of the measures taken, especially since the person concerned offered a public apology and confirmed that his statements were not intended to offend, but rather were – according to him – motivated by a warning of the dangers to which children may be exposed.
Respondents also believed that the real controversy should focus on the responsibility of parents in choosing children’s clothing, instead of turning the issue into a legal confrontation that might be interpreted as a restriction on freedom of expression, as long as the matter does not include direct incitement to violence or the commission of a crime, which is what remains within the jurisdiction of the judiciary to decide.
On the other hand, other voices stressed that protecting children from any speech that may harm their dignity or expose them to bullying remains a priority, considering that publishing content that directly addresses a child may leave psychological and social effects that require the application of the law.
The case remains before the Algerian judiciary, which will decide the extent to which the acts attributed to the accused are proven and the legal responsibility resulting from them, amid the continuing societal debate about the balance between freedom of expression and protecting children’s rights.
