The Spanish Supreme Court ruled to award financial compensation amounting to 2.5 million euros to Moroccan citizen Ahmed Al-Tamhi, after he spent 15 years in prison following his conviction in cases of rape and theft that it was later discovered that he did not commit, in one of the most prominent cases of judicial error in Spain.
Ahmed Al-Tamhi is currently 75 years old. He left Morocco in 1991 for Spain to work in the construction field, before he was arrested and convicted to 24 years in prison on charges related to two cases of rape and theft that occurred in the Catalonia region.
After many years of judicial prosecution and appeals against rulings, Al-Tamhi was able to prove his innocence, as the last accusation that was still pending against him was dropped last December, and one of the victims confirmed before the court that he was not the person who assaulted her.
In its final decision, the Spanish Supreme Court considered that the case was marred by a “clear and serious judicial error,” noting that the court that issued the original ruling did not take into account biological expertise that proved that the perpetrator of the crimes was not Ahmed Al-Tamhi.
The Spanish National Court had previously rejected his request for compensation despite his acquittal, considering that the judicial procedures taken at that time did not include an error requiring compensation, before the Supreme Court overturned this decision and recognized his right to compensation.
Al-Tamhi said in media statements after the ruling was issued: “Justice destroyed my life, and compensation will not restore my health or the years of my youth that were lost,” adding that what he was exposed to deprived him of entire decades of his life.
This case revives the debate in Spain about mechanisms for compensation for judicial errors and guarantees of a fair trial, especially in criminal cases that rely on sensitive evidence that may directly affect the fate of the accused.
