A number of representatives within the House of People’s Representatives presented a proposed law that seeks to amend some provisions of the Tunisian Nationality Code, in a step aimed at tightening the conditions for granting nationality, whether through the naturalization procedure or in certain cases related to birth within the country.
The draft stipulates the requirement of legal entry into Tunisian territory and actual and continuous residence for a period of no less than seven years before submitting an application for citizenship through naturalization, with the aim of ensuring stable and permanent ties between the citizenship applicant and the state.
The text also suggests reorganizing some special cases related to citizenship at birth, including:
- Children born in Tunisia to stateless Tunisian parents are considered if the parents have resided in the country for at least ten years.
- Granting citizenship to children born on Tunisian soil of unknown parents, unless foreign parentage is later proven.
- Infants found inside Tunisia are presumed to have been born on its territory until proven otherwise.
According to the explanatory memorandum for the initiative, the representatives affirm that citizenship represents an essential sovereign and legal tool in the hands of the state, granted according to considerations related to the national interest and security, economic and social balances.
It is expected that the project will be referred to the relevant parliamentary committees for study before being presented to the plenary session, with expectations of opening an expanded discussion about its legal, humanitarian and sovereign dimensions.
