On Wednesday, a federal judge in the United States ruled that migrants cannot be deported to Libya unless they are given the legal opportunity to challenge their deportation decisions in court. The ruling by Judge Brian Murphy in Massachusetts came after two lawyers submitted reports that US immigration authorities were planning to deport a number of migrants to Libya.
Judge Murphy had previously ruled that a person cannot be deported to a country other than his or her country of origin unless he is given an opportunity to prove that such deportation would endanger his life. In his latest decision, he added that any attempts to “imminently” deport migrants to Libya would constitute a clear violation of the court’s orders.
The judicial decision came after a report published by Reuters on Tuesday, based on statements by three American officials, who indicated that the administration of US President Donald Trump was considering for the first time the option of deporting migrants to Libya, despite continued criticism from Washington regarding human rights violations in Libyan detention centers. The officials reported that the US military was planning to deport the migrants to Libya as soon as possible, perhaps on the same day as Wednesday, but they made clear that these plans may be subject to change.
While the number of immigrants targeted for deportation or their nationalities were not specified, judicial documents stated that some of them hail from countries such as the Philippines, Laos, and Vietnam. Reports also indicated that one of the Mexican migrants was asked to sign a document allowing his deportation to Libya.
When asked about these plans, President Trump responded, “I don’t know, you’ll have to ask the Department of Homeland Security.” For its part, the US Department of Defense declined to comment and referred inquiries to the White House, which did not provide any response to journalists’ questions. The Department of Homeland Security also declined to comment on the case.
This judicial decision highlights the escalation of human rights concerns regarding the deportation policies pursued by the Trump administration, especially with regard to deporting migrants to countries with deteriorating security and humanitarian conditions. It also represents a new legal challenge for this administration, which faces widespread criticism over its controversial immigration policies.
