A human rights observatory calls on Tunisia to ensure the independence of the judiciary and warns against the politicization of corruption files

Tunisia –The Freedom for Tunisia Observatory warned of the dangers of using anti-corruption files in political conflicts, calling for respecting fair trial guarantees and strengthening the independence of the judiciary in dealing with cases of a financial and administrative nature.

The Observatory’s position came after the decision of the Tunisian Court of Appeal to postpone consideration of the “Ajeel-Sivax” case, in which businessman Mohamed Freikha and political leader and former Minister of Transport Abdel Karim Al-Harouni are being pursued, along with other officials, against the backdrop of suspicions related to commercial transactions and contracts related to the hydrocarbons sector.

The Observatory stressed that combating corruption and protecting public funds represent a legitimate priority, but this must be done within the framework of full respect for the rights of the defense and the presumption of innocence, while providing all conditions for a fair and transparent trial.

He also expressed his concern about the increasing prosecutions targeting political figures, businessmen, and officials whose names were associated with the post-revolution period, considering that the current political climate requires more transparency and clarity in the management of these sensitive judicial files.

The Observatory stressed that the fight against corruption should be based on material evidence, independent technical reports, and reasoned judicial rulings, far from any political or media considerations that may affect the course of justice.

He called for ensuring the right of all observers to public trials in which all legal guarantees are available, respecting the right to appeal, and completing the various stages of litigation before issuing any final rulings.

He also called for separating anti-corruption efforts from any potential political exploitation of the judiciary, while emphasizing the importance of adhering to international standards for the independence of the judiciary and the protection of fundamental rights and freedoms.
