Tunisia– The criminal division responsible for financial corruption cases at the Court of First Instance in Tunisia issued six-year prison sentences against former officials in a ministry and the general manager of a company specialized in selling cars, after they were convicted in a case related to a public deal marred by breaches that caused financial and material damage to the state.
The rulings came against the backdrop of the prosecution of the accused on charges of exploiting a public employee’s position to harm the administration, based on Articles 82, 96 and 98 of the Tunisian law, due to a public deal regarding the acquisition of cars for the benefit of one of the public administrations.
The details of the case go back to the year 2013, when the concerned administration concluded a deal to supply 88 cars, before an investigation launched following a complaint filed by the Public Incharge of State Disputes revealed the existence of several imbalances in the deal, most notably the absence of technical specifications related to safety conditions within the load tables.
Investigations showed that the cars that were purchased were suffering from technical defects, which caused a number of traffic accidents that resulted in losses, according to what was stated in the official complaint.
The research included former officials of the relevant ministry, in addition to the president and general manager of the car sales company that won the deal, before the trial ended with their conviction and prison sentences being issued against them.
