A Tunisian MP was imprisoned for 8 months due to a satirical blog post by Kais Saied… and the return of the controversy over freedom of expression

The Criminal Chamber of the Court of First Instance in Tunisia ruled to imprison Parliament member Ahmed Al-Saidani for eight months, after he was prosecuted on charges of insult through public means of communication, against the backdrop of a blog post he published on Facebook that included critical expressions directed at the President of the Republic, Kais Saied.

The ruling came days after the person concerned was imprisoned this month, after publishing content that the competent authorities deemed offensive, at a time when the Tunisian political scene is witnessing a continuing state of polarization between the president’s supporters and his opponents.

Al-Saidani, who belongs to the “Sovereign National Line” bloc, was previously a supporter of the July 25 process, before he turned in recent months into one of the critics of the president’s choices, accusing him of managing public affairs alone and holding other parties responsible for political and economic stumbles.

The bloc to which the representative belongs expressed its rejection of the decision to arrest and prosecute, considering that the measures taken are not consistent with legal guarantees, and called for respecting the applicable judicial procedures. Other representatives also raised the issue of the balance between freedom of expression and the role of Parliament in holding the executive authority accountable.

This issue comes in light of the continuing repercussions of the political path launched by President Kais Saied on July 25, 2021, which included the dissolution of the previous parliament, the executive authority assuming expanded powers, and the issuance of presidential decrees, before approving a new constitution through a referendum and organizing early legislative elections.

These developments revive the debate within Tunisia regarding the limits of freedom of opinion in the digital space, and the extent to which political tension affects the relationship between the authorities, at a stage in which the country is still searching for sustainable institutional and economic stability.
